These Terms of Service (“Terms”) govern your access to and use of the Brain Sniper game, website, mobile applications, and all related services (collectively, the “Service”) provided by Jet Black Lion (“Jet Black Lion,” “we,” “us,” or “our”), with principal place of business in Florida, USA. The Service includes all features, content, and community forums, including the upcoming Word Esports HQ and Community Hub.
By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2.1 Developer & Rights Holder. Jet Black Lion is the developer, operator, and exclusive rights holder of Brain Sniper. All rights not expressly granted to you are reserved by Jet Black Lion, at the level of a AAA gaming brand.
2.2 Brand Figure. Alicia Marie Phidd is the Influencer, Live Caster, and public‑facing brand ambassador for Brain Sniper. By using the Service, you acknowledge that you are engaging with Alicia Marie Phidd and her cross‑platform community as part of the Brain Sniper ecosystem.
2.3 Intellectual Property. All software, graphics, logos, game mechanics, word lists, audio, video, and original content are owned or licensed by Jet Black Lion. Your use of the Service does not transfer any ownership rights to you.
3.1 Age Requirement. You must be at least 18 years old to create an account or use the Service. If you are under 18, you may not use Brain Sniper. Parents are fully responsible for any use of the Service by their minor children, in violation of this rule. The Service complies with the Children’s Online Privacy Protection Act (COPPA) by prohibiting users under 13 (and under 18) from creating accounts.
3.2 Account Creation. You must provide accurate, current, and complete information. Your username is permanent after your first game (see Section 4.3). You are responsible for all activity under your account.
3.3 One Account per User. You may not create multiple accounts to evade bans or manipulate rankings, referrals, or tournaments.
4.1 Limited License. Jet Black Lion grants you a non‑exclusive, non‑transferable, revocable right to access and use the Service for personal, non‑commercial entertainment purposes, subject to these Terms.

4.3 Permanent Username. Your chosen username is permanent after your first game. It cannot be changed. This ensures leaderboard integrity and fair ranking.
5.1 Live Casting. Alicia Marie Phidd, as Live Caster, has the right to broadcast, commentate, and stream gameplay sessions (including player names, scores, guesses, and chat) on her cross‑platform channels (e.g., YouTube, Twitch, TikTok, X, etc.).
5.2 Spectator Mode. The Service includes a public spectator view. By playing, you consent to your gameplay being visible to spectators and recorded for esports highlights and promotional materials.
6.1 Consent. By using the Service (whether as a Player or an audience member / spectator), you irrevocably grant Jet Black Lion the perpetual, worldwide, royalty‑free right to use your:

6.3 No Compensation. You will not receive any compensation for such uses. This is a standard industry practice. If you do not agree, do not use the Service.
7.1 Virtual Currency. Brain Sniper may offer Virtual Currency (e.g., Tickets, Coins, Gems) for purchase with real money. Virtual Currency is a limited, non‑transferable, revocable license to access certain features or cosmetic items.
7.2 No Refunds. All purchases of Virtual Currency and in‑game items are FINAL AND NON‑REFUNDABLE, except as required by applicable law (Florida law does not require refunds for digital goods). This includes unused Virtual Currency.
7.3 Cosmetic Only. Skins, avatars, and other purchasable items are purely cosmetic. They provide no competitive advantage (no pay‑to‑win).
7.4 Future Subscription. We may introduce a battle pass, premium membership, or subscription service. Any such service will be governed by additional terms, and you may cancel at any time.
The Community Hub (subdomain `community-brains.jetblacklion.com`) and any integrated chat or forum features are subject to strict moderation. The following conduct is strictly prohibited:
Moderation. Moderators (Jet Black Lion staff, volunteers, and future automated systems) have full discretion to remove content, issue warnings, suspend, or permanently ban Users without prior notice. Ban appeals may be sent to HQ@jetblacklion.com.
We collect and process your data as described in our Privacy Policy. Key points include:
Data Retention. We retain your data as long as your account is active. Upon account deletion, we delete or anonymize personal data, except for historical leaderboard entries, game history (which may be retained for esports record‑keeping), and any content that has already been broadcast or published. You may request account deletion by contacting HQ@jetblacklion.com.
10.1 Governing Law. These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of laws principles.
10.2 Mandatory Mediation. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be submitted to binding mediation administered by a mutually agreed mediator (or appointed by the American Arbitration Association if the parties cannot agree).
10.3 Arbitration. If the dispute remains unresolved after twelve (12) months from the date of the last mediation meeting, either party may initiate binding arbitration. The arbitration shall be administered by the American Arbitration Association under its Commercial Arbitration Rules.
11.1 By Jet Black Lion. We may suspend or terminate your access to the Service at any time, without notice, for any violation of these Terms, or for any other reason (including inactivity).
11.2 By You. You may delete your account by contacting HQ@jetblacklion.com. After deletion, you will lose access to all Virtual Currency, skins, and progress. You may not create a new account with the same username.
11.3 Survival. Sections 5 (Streaming), 6 (Marketing Rights), 8 (Community Rules), 10 (Dispute Resolution), and 12 (Disclaimers) survive termination.
12.1 As Is. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” JET BLACK LION MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR ERROR‑FREE OPERATION.
12.2 No Liability for Downtime. We do not guarantee that the Service will be uninterrupted, secure, or free of bugs or viruses.
12.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, JET BLACK LION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO JET BLACK LION IN THE PAST SIX MONTHS, OR $50, WHICHEVER IS LESS.
12.4 Florida Law Controls. Some jurisdictions do not allow certain disclaimers – in such cases, these disclaimers apply to the fullest extent permitted by Florida law.
We may update these Terms from time to time. We will notify you of material changes via email or by posting a notice in the Service. Your continued use after the effective date constitutes acceptance of the revised Terms.
